Rental Agreement

9.1 Purpose and Incorporation
This Rental Agreement applies to every booking involving one or more physical rental items on RentHaus. It forms part of the binding transaction terms between the customer and the relevant vendor and is read together with the RentHaus Terms of Service, Customer Agreement, Deposit and Security Deposit Policy, Damage/Loss/Late Return Policy, Refund and Cancellation Policy, and any booking-specific terms shown at checkout.
9.2 Parties and Marketplace Role
The rental contract is between the customer identified on the booking and the independent vendor supplying the rental item. RentHaus provides marketplace, booking, payment, recordkeeping, deposit-handling, notification, and dispute-support infrastructure. Unless expressly stated, RentHaus is not the owner, lessor, manufacturer, operator, or insurer of the rented item.
9.3 Booking-Specific Rental Details
The booking receipt and checkout summary form part of this Agreement and should identify the rental item, quantity, rental start and return date/time, pickup or delivery method, approved location, rental fee, delivery or setup charges, refundable security deposit, cleaning fee where applicable, late-return charges, vendor details, and any accessories or components included.
9.4 Booking Confirmation and Payment
A rental is not confirmed merely because an item is added to a cart, a booking request is submitted, or a quote is accepted. The rental becomes confirmed only after RentHaus verifies the required payment or deposit and creates a confirmed booking record. Availability may be rechecked before payment, and temporary checkout holds may expire.
9.5 Rental Period and Extensions
The customer may possess and use the item only during the rental period shown on the booking. An extension is valid only when requested and approved through RentHaus before the original return deadline and any additional fees are paid. Keeping an item beyond the agreed period without approval is an unauthorized extension and may trigger late fees, deposit deductions, account restrictions, recovery action, or loss-of-business charges where another booking is affected.
9.6 Delivery, Pickup, and Access
The customer must provide accurate delivery, pickup, venue, access, parking, loading, power, security, and contact details. The customer is responsible for ensuring that the location is accessible and suitable for delivery, installation, use, and collection. Additional waiting time, failed delivery, redelivery, relocation, access restrictions, or customer-caused logistics may attract disclosed additional charges.
9.7 Inspection and Handover
At delivery or pickup, the customer should inspect the item and confirm its condition, quantity, listed accessories, and apparent functionality. Existing defects, shortages, stains, or damage must be reported through RentHaus immediately or within the stated handover window. RentHaus may require digital acceptance, photos, videos, serial numbers, item tags, delivery notes, signatures, OTP confirmation, or other handover evidence.
9.8 Customer Care and Permitted Use
During the responsibility period, the customer must:
• Use the item only for its lawful, intended, and agreed purpose.
• Follow vendor operating, safety, installation, storage, weather, electrical, and handling instructions.
• Keep the item secure and under appropriate supervision.
• Prevent unauthorized use, sub-rental, transfer, movement, alteration, repair, or modification.
• Not remove labels, serial numbers, safety devices, tracking devices, tags, or identifying marks.
• Stop using the item and notify RentHaus promptly if it becomes unsafe, defective, damaged, lost, or stolen.
9.9 Prohibited Uses
A customer must not use a rented item for an illegal, unsafe, deceptive, abusive, or unauthorized purpose; operate it while unqualified or impaired; exceed stated capacity or load limits; expose it to avoidable weather or electrical hazards; move it outside the approved location; sub-rent it; pledge or sell it; or allow a third party to take possession without vendor approval.
9.10 Item Condition, Damage, and Normal Wear
The customer must return the item in substantially the same condition in which it was received, allowing only reasonable normal wear and tear. The customer may be responsible for verified damage, stains, burns, breakage, electrical misuse, water damage, missing accessories, unauthorized alteration, contamination, abnormal cleaning, or loss in accordance with the applicable policies.
9.11 Loss, Theft, and Non-Return
The customer must notify RentHaus immediately if an item is lost, stolen, seized, abandoned, or cannot be returned. RentHaus or the vendor may require an incident statement, police report, security report, venue records, witness details, or other evidence. The customer may remain responsible for verified recovery, repair, or replacement costs, including amounts exceeding the security deposit.
9.12 Security Deposit and Deductions
A refundable security deposit may be required before release of the item. The deposit is not rental income and may be held pending return confirmation and claim review. Verified deductions may be made for damage, loss, theft, late return, unauthorized extension, missing accessories, cleaning, recovery logistics, inspection, repair, replacement, or other booking-specific liabilities. Any deduction must follow the RentHaus Deposit and Security Deposit Policy and applicable dispute process.
9.13 Return, Collection, and Late Return
The customer must make the item available for return or collection at the agreed place and time, with all accessories and packaging listed on the booking. The customer remains responsible until the vendor accepts return or RentHaus records completion of the return handover. Late-return charges and verified loss-of-business costs may apply where permitted by the booking terms and applicable law.
9.14 Cleaning and Fashion Rental Requirements
Where the rental involves wedding gowns, traditional attire, suits, accessories, linens, decor fabrics, or other fashion and textile items, the customer must comply with the Fashion and Occasion Wear Rental Policy. Unless expressly authorized, the customer must not wash, dry-clean, dye, cut, stitch, glue, resize, permanently pin, or otherwise alter the item.
9.15 Vendor Responsibilities
The vendor must:
• Have lawful ownership, control, or authority to rent the item.
• Provide an item that is accurately described, safe, functional, clean where applicable, and available for the confirmed period.
• Disclose material defects, operating requirements, accessories, deposits, fees, restrictions, and replacement value where applicable.
• Provide and retain appropriate handover and return evidence.
• Submit damage, loss, cleaning, or late-return claims honestly, promptly, and with supporting evidence.
• Not demand undisclosed or unauthorized off-platform payments or deposits.
9.16 Cancellation and Failed Fulfilment
Customer cancellation is governed by the Refund and Cancellation Policy and the booking-specific terms accepted at checkout. If the vendor cannot provide the confirmed item, RentHaus may arrange a replacement where practical, cancel the booking, process an eligible refund, or apply vendor performance controls. A pre-payment vendor withdrawal is not the same as cancelling a confirmed paid booking.
9.17 Disputes and Evidence
Any dispute concerning delivery, condition, quantity, suitability, damage, loss, cleaning, late return, deposit deductions, or non-return should be submitted through RentHaus within the stated claim window. RentHaus may hold deposits, payouts, or refunds while reviewing the evidence under the Dispute Resolution Policy.
9.18 Electronic Acceptance and Records
The customer accepts this Agreement electronically during checkout. RentHaus may record the accepted agreement version, booking ID, user ID, acceptance timestamp, IP address, device/browser information, checkout session, and transaction reference. Electronic acceptance has the same effect as signing a paper agreement to the extent permitted by applicable law.
9.19 Agreement Version and Booking-Specific Priority
Each booking must retain the version of this Rental Agreement accepted at checkout. Later policy updates do not replace the version attached to an existing booking unless the parties expressly agree. Where a booking-specific term conflicts with a general term, the more specific booking term applies, except where it violates applicable law or a mandatory RentHaus safety or marketplace rule.
9.20 Governing Law
The laws of the Federal Republic of Nigeria govern this Agreement. Nothing in this Agreement removes any non-waivable consumer right or legal remedy available under applicable law.
